My mother was just convinced to sign over her property, over $800,000 in assets over to her neighbor and her son. We also discovered that the same family has been taking money from her accounts and convincing her that her family (daughter) is doing it. No one will help and I can't seem to get an attorney take the case but everyone says it is a criminal matter. What can I do? Mother has had mental health issues in the past and has been told she is having dementia issues but no official diagnosis. She shows the classic signs of alzheimers for anyone who has known her a long time.


She also says that her neighbor told her that she had to give her the houses (2) because it was good payment for her taking her to a couple doctors offices.


What can I do? I don't have much money due to my medical bills and my daughters medical bills.....

It's a criminal offence, ie, theft. Lawyers don't get involved in the first instance, police do. Then after charges are laid, you can get a lawyer.

How did your mother sign this over?
Is the son her POA?
Has the attorney you went to with this complete story (I hope more complete than here) told you to go to the police?
Have you gone to the police?
Who told you all of this about the neighbor and about the son?
Is the son your brother? Have you talked to the son?
Have you talked to the neighbor?
Do you all live in the same town?
You say she has changed her will. What will. She apparently no longer has anything to leave anyone.
How do you know she changed her will?
You say she has dementia. Has she been the one telling you these stories?

You will need to go to the Police.
They will tell you if this is a case for them to file on, work on, or if you should be going to an agency about Elder Abuse.
You need to go at ONCE to the police with a very COMPLETE list of everything that you KNOW has happened, when it happened, and who it involved.

The neighbor convinced her to avoid paying for potential nursing home charges to sign over her assets to the neighbor.
The police were there at one point and said that its a civil matter but they won't listen to whole story.
I learned because I lived at one of the houses that she bought for my kids and we were moving into another house and had not finished moving out of our old house. The new owner started moving our things out and throwing them away.
Mother told me she had signed some papers but didn't know what type papers. She did know she had already signed the deed of her own house to the neighbor but she still pays all the bills for her house.
A former POA that mother had set up years ago to avoid this was trying to help her when the neighbor had mother revoke his power of attorney.
The son is not my brother, no relation at all. She did not even known his name when the police and I questioned her just said he had blonde hair and was nice.
The neighbor and son won't talk to me. They have made it where I cannot see my mother by putting a no tresspass on me and my family, including her teenage grandchildren.
She had been taken to change her will and then she just signed all the deeds to the properties.
Her doctor who did surgery on her told me she had dementia but he was not able to diagnose her with it because he worked on bowels. She was also in a mental institution and has always refused treatment for bi-polar.

This is crazy. What reason have the lawyers given you for not taking the case? I would think their cut of the money would make it worth their while? Would moms Dr back up your ALZ claims? I know you said no official diagnosis, but "has been told" she has issues.. by whom?

Per the OP-the lawyers won’t take it because it’s a criminal case.
