Yes but needs to be FMV. Best strategy is to consult an CELA, since we are neither realtors nor attorneys.

Do you mean that you are a co-POA agent or a successor agent? Yes, speak with an elder law attorney because this makes a difference. Also, is this sale in the best interest of your grandmother? That is the gist of the POA agent's job. The sale must be of benefit to her and no one else.

If he pays fair market value it shouldn't be a problem.

If he gets it for pennies on the dollar it is problematic.

Not just because you are the 2nd POA but, any public assistance is going to have an issue with her home being sold under market value.

I would speak with a certified elder law attorney to make sure it is all done in accordance with the law. That's how you avoid any issues of self dealing or messing up potential aid when needed.
